Digital Bibliography of Cypriot Law

Welcome to the Digital Bibliography of Cypriot Law. The main body of the present work contains over 1500 bibliographical references and 30 main categories, which were drafted so that the bibliography is as easy to use as possible. The categorisation aims not to achieve legal precision, but rather to enable the researchers and users to find the material they are looking for. The Digital Edition will be constantly updated with new bibliographical additions and will remain open to the public and free of charge. For more information the reader is referred to the About section.

A. Legislation

The main source for legislation is the Official Gazette of the Republic of Cyprus (Επίσημος Εφημερίς της Δημοκρατίας) which has been published since Independence (16.8.1960). The House of Representatives of the Republic also publishes the Minutes of its Plenary Meetings since Independence (16.8.1960). The most updated website concerning Cypriot legislation is www.leginet.eu

The Constitution of Cyprus, as well as the Treaty of Establishment, the Treaty of Guarantee, the Treaty of Alliance and other important legal documents concerning Independence may be found in English in Cyprus, Presented to Parliament by the Secretary of State for the Colonies, the Secretary of State for Foreign Affairs and the Minister of Defence by Command of her Majesty, Command 1093, London, Her Majesty’s Stationery Office, 1960. The original text of the Constitution has been published separately in Greek and Turkish.

The most complete collection of Legislation since Independence was published in 15 volumes by Κορακίδης Επαμεινώνδας, Κορακίδου Μαρία, Νόμοι της Κυπριακής Δημοκρατίας, Πάφος 1998-2001.

A comprehensive collection of some of the most important laws of the Republic were collected in Ανδρέας Νεοκλέους & Σία ΔΕΠΕ, Εγκόλπιο Κυπριακών Νόμων, Νομική Βιβλιοθήκη, Αθήνα, 2008, σσ. 1231.

The Republic of Cyprus has officially published its Subsidiary Legislation since Independence in 2002 (Κυπριακή Δημοκρατία, Διαδικαστικοί Κανονισμοί 1960 – 2001, Λευκωσία, 2002).

The Constitution of Cyprus has been published in Greek and English and translated into demotic Greek by Αδαμίδης Μάριος, Σύνταγμα της Δημοκρατίας της Κύπρου, Λευκωσία, 2004. The 1960 Treaties have been published by Macris D. Nicolas, The 1960 Treaties on Cyprus and Selected Subsequent Acts, Mannheim: Bibliopolis, 2003.

The Cyprus Gazette was published from 1878 until 11.8.1960 and contained legislation enacted during the British Rule of Cyprus. The Laws of Cyprus in force on 1st April 1959, before Independence, were compiled by then Attorney-General Criton Tornaritis and are separated into six volumes and Chapters (Caps). Laws who continue to be in force after Independence are referred to by their respective Cap in the 1959 edition (e.g. Interpretation Law is Cap. 1, Advocates Law is Cap. 2 etc.).

Palaiologos had published an Index of Legislation before Independence in Παλαιολόγος Κ. Α, Κλεις της Κυπριακής Νομοθεσίας από της Αγγλικής Κατοχής μέχρι του 1899, Λευκωσία, 1900.

The Charter currently in force of the Orthodox Church of Cyprus was published in the official journal of the Church Apostolos Varnavas, as well as in a special publication in 2010. Previous Charters had been published in 1979, 1929 (however, it never entered into force) and 1914 (a Procedure of the Ecclesiastical Courts was enacted in 1917). The Regulations of the Armenian Diocese of Cyprus were published in Nicosia in 1950.

B. Case - Law Reports

The Judgments of the Supreme Court of Cyprus have been officially collected in the Cyprus Law Reports (CLR). Cases decided before Independence (1883-1960) were published in 24 volumes from 1893 until 1960. Cases decided after Independence have been collected in yearly volumes, with Part 1 (published since 1960) referring to Civil Cases, Part 2 (published since 1960) to Criminal Cases and Part 3 (published since 1965) to Administrative Cases. In 1964 only one volume was published comprising both Part 1 and Part 2.

Before 1989 the Cyprus Law Reports were published in English, while since 1989 they have been published in Greek as Αποφάσεις Ανωτάτου Δικαστηρίου (ΑΑΔ). Since 1991 Part 1 further contains the Judgments of the Appeal Family Court. The Editors of the Cyprus Law Reports have been Markides Frixos (1961-1974), Kallis Panayiotis (1975-1985), Markides A. Hermione, Markides F. Alekos (1985-1990), Andreas Ladas (1991-1994, Part 1), Marios Kyriakides (1995-1996, Part 1), Papathoma-Kalligerou Marika (1991-1992, Part 3), Michaelidou Marietta (1991 onwards for Part 2, 1993 onwards for Part 3, 1997 onwards for Part 1).

All the judgments of the Supreme Constitutional Court of Cyprus have been collected in the Reports of the Supreme Constitutional Court of Cyprus from 1960-1963 in 5 volumes. The Editor was Fisentzides Chris.

From 1965-1987 the Judgments of the Supreme Court of Cyprus, as well as certain important judgments of the District Courts were published monthly in Judgments of the Supreme Court of Cyprus on Appeal and in its Original Jurisdiction and in Certain Cases Decided by District Courts in which there was no Appeal (JSC). The Editors were Constantinides Theodoros (1965-1968), Kallis Panayiotis (1969-1974), Markides A. Hermione, Markides F. Alekos, (1975-1987). From 1993-2005 Kyriakides Marios had been publishing monthly the Judgments of the Supreme Court and selected Judgments of District Courts in Αποφάσεις Κυπριακών Δικαστηρίων (ΑΚΔ).

A comprehensive and constantly updated website containing all Supreme Court Judgments, as well as recent District Court Judgments is www.leginet.eu. Supreme Court Judgments are also included in the constantly updated website www.cylaw.org which is free to the public.

Zekia Mehmet published a Cyprus Law Reports Digest of Cases Reporter in Volumes I to XX of the Cyprus Law Reports, which were decided before Independence. Constantinides Rogiros compiled a subsequent Cyprus Law Reports: Digest of Cases Containing Civil and Criminal Cases, Decided in the Years 1956 – 1971. Denktash R. Rauf compiled A Handbook of Criminal Cases, Nicosia, 1955 which contained judgments decided before Independence. Cacoyiannis P. George published three volumes of collected cases in his Cyprus Casebook, v. I (1888-1969), Limassol 1978, v. 2 (1970-1977), Limassol, 1980, v. III (Index), Limassol, 1989 (Pattichis Elena had previously published an Index to Cyprus Casebook by Cacoyiannis, Limassol, 1981). Nikos Charalambous compiled a casebook of public law judgments for the year 1990 in Χαραλάμπους Νίκος, Δελτίο Νομολογίας, Εκδόσεις Ινστιτούτου Συνταγματικού και Διοικητικού Δικαίου, Λευκωσία, 1990.

A collection of Judgments concerning Family Law have been published by Liassides Soteris in 2006 (Λιασίδης Σωτήρης, Οικογενειακό Δίκαιο: Αποφάσεις, τ. ΙΙα, Λευκωσία, 2006) and updated with new judgments from 2006-2010 in 2011 (Οικογενειακό Δίκαιο: Αποφάσεις 2006-2010, τ. ΙΙβ, Λευκωσία, 2011).

27 volumes containing Decisions of the Industrial Relations Tribunal had been published as Δικαστήριο Εργατικών Διαφορών: Αποφάσεις. Volumes 1-5 were published as Διαιτητικόν Δικαστήριον: Εκθέσεις Αποφάσεων του Διαιτητικού Δικαστηρίου. Editors were Pisiaras Rovertos (v. 1-19) and Raspopoulos Savvas (v. 20-27). The Cyprus Employers and Industrialists Federations has published a collection of judgments of the Industrial Relations Tribunal in 1996 as Ομοσπονδία Εργοδοτών και Βιομηχάνων, Αποφάσεις Δικαστηρίου Εργατικών Διαφορών, Λευκωσία, 1996.

Judgments of the Rent Control Tribunal have been collected in 9 volumes. The first eight volumes were edited by Coucounis Andreas as Κουκούνης Ανδρέας, Ενοικιοστάσιο, τ. Α΄ - Η΄, 1986 - 2003, Λευκωσία - Λάρνακα. The ninth volume, edited by Andreas Coucounis & Co, was published in Larnaca in 2005 and contains the judgments from 2000-2004.

Judgments referring to Tax Law were compiled by Savvides Savvas, Reports of Cyprus Tax Cases, v. I – VIII, Institute of Certified Public Accountants of Cyprus, 1995 and by Νεοφύτου Νεόφυτος, Συνοπτικός Οδηγός Αποφάσεων Δικαστηρίου Φορολογικών Υποθέσεων, τ. An Index to Treaties in Force was compiled by the Office of the Law Commissioner of the Republic of Cyprus, Index of Treaties: 1960 - 2005, Nicosia, 2006, pp. 510. The Republic had previously published an Index to the Treaties and their Status, Nicosia, 1986 and Supplement (1986 – 1991). Mavrommatis Andreas and Yiangou Christophoros had previously edited A List of Treaties of the Republic of Cyprus in Force on the 1st January 1974, Nicosia, 1974, pp. 35.

The Cyprus and European Law Review has published an Index to issues 1-12 in (2011) 12 Cyprus and European Law Review. The Cyprus Law Review published an Index to its volumes for the years 1983-1987 as follows: Επιθεώρηση Κυπριακού Δικαίου, Ευρετήριο Τόμων 1983 – 1987, Εκδόσεις Ασσέλια, Λευκωσία. D. Cypriot Legal Journals

The official journal of the Cyprus Bar Association, the Cyprus Law Tribune (Κυπριακό Νομικό Βήμα) was first founded in 1967 by Clerides Lefkos, then Chairman of the Cyprus Bar Association. The Tribune was initially being published every two months. In 1981 the publication of the Tribune was discontinued. The Tribune was published again from 1988 - 1995 and from 2000 onwards with the Chairman of the Cyprus Bar Association acting also as Editor of the Tribune. The Tribune is currently published thrice a year. The following have been Editors of the Tribune: Clerides Lefkos (1967-1981), Papaphilippou Loukis (1988-1993), Xenopoulos Xenios (1993-1995), Papaefstathiou Nicos (2000-2006), Ioannides Theodoros (2006 onwards).

The Cyprus and European Law Review (Επιθεώρηση Κυπριακού και Ευρωπαϊκού Δικαίου) was founded in 2006 by Emilianides C. Achilles, who continues to be the Editor of the Review. From 2006-2010 the Review was published three times a year by Dikaionomia Legal Publications, while from 2011 onwards the Review is published by . From 2009 onwards the Review is published under the scientific direction of the Law Department of the University of Nicosia. 12 issues of the Review have so far been published. The Review is a peer-reviewed journal.

The Cyprus Law Review (Επιθεώρησις Κυπριακού Δικαίου) was founded in 1983 as a quarterly publication published by Asselia Publications, with Nicolaou Eliana and Nicos Koutsou acting as Editors until 1996 when the publication was discontinued. The following volumes of the Review were published: 1 - 44, 49 - 50, 53 – 56.

Lysias (Λυσίας) is the official journal of the Nicosia Bar Association. Lysias was founded in 1994 and published without regularity until 2006. From 2008 onwards the journal is published by Nomiki Vivliothiki Publications of Athens with Nikitas Hadjimichael, Assistant Professor of the University of Cyprus, being the Editor. Two issues of the journal have so far been published under its new direction.

The Family Law Review (Επιθεώρηση Οικογενειακού Δικαίου) was launched in 2010 as a quarterly publication, with Judge Liasides Sotiris as the Editor.

Legal & More was launched in 2009 as a quarterly magazine with Georghiou Elena, a Cypriot lawyer from Larnaca, acting as Editor.

A short-lived publication was the Review of Public and Private Law (Επιθεώρησις Δημοσίου και Ιδιωτικού Δικαίου). The Review was published quarterly in 1967 in Nicosia with four issues being published in total. Ioannis Daskalakis was the Editor of the Review.
